Terms and conditions

The following Terms and Conditions apply to your (The guest’s) stay in the units at The Windsor Apartments and Hotel Rooms, Brisbane (The property / The hotel), 186 Lutwyche Road, Windsor.

General

Terms & Conditions below are for all bookings made either directly e.g. via the Hotel’s website or via 3rd parties for The Windsor Apartments and Hotel Rooms, Brisbane. These terms and conditions may be updated from time to time and are subject to change at the hotel’s discretion without further notice. 

Self-contained accommodation

The guest understands that the Units are “SELF-CONTAINED”. That means that guests agree to maintain the property in a tidy condition and returns it in approx. in the same condition in which it was found. That includes a clean and proper standard, switching off of appliances and assuring waste removal into the public rubbish bins. Used linen does not need to be stripped from the beds. For extra cleaning or damage, charges apply. During the stay units are to be kept orderly and clean. Support / cleaning service is available against a charge.

Cleaning / Support

Support personnel require access to the units to provide regular services (e.g. service / cleaning / exchange of towels). 

Early Check-In / Late Check-Out

Early check-ins and late checkouts may be available upon request. Please contact reservations to check availability and cost. An early check-in fee or late check-out fee may apply, also automatically for late-check-outs if the property is not vacated prior to the set check-out time of the property.

Early Check-Out Date / Early departure / Cancellation

Bookings are non-refundable after check-in. The property reserves the right to cancel the stay and reservation at any time for any reason based on these terms. 

No Party Policy / Guests / Over-Occupancy

The Windsor Apartments and Hotel Rooms, Brisbane has a strict no party policy. In the event that any apartment/guest is identified as having a party, the hotel reserves the right to immediately request all occupants of the apartment up to, and including, the guest who has registered for the apartment to vacate the premises. In the event that an eviction does occur, the accommodation is non refundable nor the bond/deposit. All occupants and guests in the unit can be held liable. In addition, the registered guests will be required to settle the account prior to departure for any expense resulting from additional cleaning of the apartment, replacement of any furniture/fixture/fitting breakage, as well as for any required repairs. Maximum 2 visitors are allowed during daytime. Without seeking an written agreement (e.g. by SMS / Email) with site management, between 10pm and 6am the accommodation is strictly limited to the booked guests only.

Fire hazards

This is a modern hotel with modern fire services. Smoking inside is strictly forbidden. Smoke through burning food may also cause a fire alarm. A fire brigade call-out will cost the guest approx. $1,500.00. Tampering with the fire equipment is an offence and leads to immediate eviction without refund. E-Scooters, E-bikes and other large batteries have recently caused fires and are currently not yet safe and are therefore currently strictly prohibited in the units (wheelchairs excepted). Bringing them indoors will also lead to an immediate eviction without refund.

Cancellation by the property

The property reserves the right to cancel the stay and the reservation at any time for any reason (e.g. over-occupancy, condition, ..). 

Guarantee Policy

A valid Credit Card is required at time of booking and a valid Credit Card must be presented at time of check in. 

Payment policies

Different policies apply following the terms of the individual reservation when full payment is required. However, the usual time for full payment is at check-in. While the hotel may accept payment from third paries, the guest has the final responsiblity for payment (not the booker). A valid Credit Card is required at time of booking. Changes and cancellation policies apply following the terms of the individual reservation. Changes or cancellations within the terms will be charged in full. No shows will also be charged as per the terms of the booking.

Identification

Upon arrival at the property, the booker and every guest must provide valid International, Federal or State Government issued photographic identification for security purposes. The ID must be under the name of the person booked and checking in. 

Bond / Deposit Policy

A Bond/Deposit via Credit Card is required upon check in. Extra costs, for example for damage, uncleanliness, etc. shall be deducted from the bond before returning the bond balance after departure. The return period of the bond depends on the guests bank and is usually between 24 hours to 14 days (e.g. for some international cards). The bond does not preclude from claiming further costs due to further damage or other costs. In case of a pre-authorisation, we cannot release, remove or lower the authorised amount, until we process the final account on departure. The Windsor Apartments and Hotel Rooms, Brisbane reserve the right to pre-authorise all credit cards upon check in. Cash is usually not an acceptable form of bond when staying with The Windsor Apartments and Hotel Rooms, Brisbane. In case of a cash bond any refund complaint must be raised by the guest directly on the day of departure or will be invalid. The bond amount depends on the number of booked guests, the size of the unit, the duration of stay and day of week. E.g. weekend single nights require a higher bond.  

Child Policy

Small children sleep free on existing bedding, within the maximum allowed guests per room. If a roll away / cot / sofa bed is required, charges may apply.

“Child” or “Children” means a person or persons aged between 3 years and 12 years; “Infant” means a person under the age of 2 years; and “Adult” means a person aged 13 years or over. All ages will be determined from the date at which accommodation commenced. Children and Infants may not stay in any room without an Adult.

Fees

All credit / debit card payments made to The Windsor Apartments and Hotel Rooms, Brisbane via an onsite payment system will incur a 1.95% non-refundable credit card service fee in Australia. 

Facilities 

If any feature/facility is essential for the guest in choosing a particular property, we recommend contacting the hotel prior to booking. The Windsor Apartments and Hotel Rooms, Brisbane cannot be held liable for omissions or errors whether temporary or permanent of a property’s facilities and services. Photos shown on the website are indicative only and may not specifically represent the exact room allocated to you. Images and descriptions apply to room categories where units may differ within the category (views, etc.). Destination images featured on the The Windsor Apartments and Hotel Rooms, Brisbane website may not represent the views offered from our locations. Accommodation facilities listed may not apply to all room types.

Internet Access

The Windsor Apartments and Hotel Rooms, Brisbane offers inclusive cabled and Wi-Fi internet access. The Windsor Apartments and Hotel Rooms, Brisbane cannot be held responsible for non-availability of the Internet network, inability of accessing the Website, external intrusion, computer viruses, or non-authorized online transactions using our Wi-Fi access. 

No-Shows / Failure to Cancel

Each rate booked at a The Windsor Apartments and Hotel Rooms, Brisbane is subject to a Cancellation Policy. Failure to check in on the reserved arrival date will incur a penalty charge as detailed in the Cancellation Policy of the particular type of rate booked. We reserve the right to cancel or modify reservations where it appears that a customer has engaged in fraudulent or inappropriate activity or under other circumstances where it appears that the reservations contain or resulted from a mistake or error. We reserve the right to cancel or amend bookings if they do not adhere to our terms & conditions. If a guest chooses to shorten their stay or check out early, a penalty charge will apply, as detailed in the Cancellation Policy associated with the rate booked.

Pricing / Specials

Special offers and deals of all kind are non-refundable. Also failure to attend or cancellation will result in a full charge. The Windsor Apartments and Hotel Rooms, Brisbane reserve the right to cancel contracts based upon incorrect information being displayed in relation to price, inclusions or service at any point in time.

Foreign Currency

Conversion into foreign currency is given as an indication and is not binding. Only the currency confirmed during your reservation is confirmed.

Relocation 

In the event of a situation whereby the Property cannot provide accommodation as previously confirmed for any reason, the Property will endeavour to relocate guests without guarantee of success to a comparable property at its absolute discretion with no additional cost to the guest. Alternatively, the hotel can provide a refund and the guest agrees that that no further claims shall be made against the property. Should the guest wish to choose a property of a higher standard other than offered under this condition, the guest will be required to pay any price difference. 

Disclaimers / Use of hotel

As a condition of your use of this Website and the hotel, you warrant to The Windsor Apartments and Hotel Rooms, Brisbane that you will not use this Website and the hotel for any purpose that is unlawful or prohibited by these terms, conditions, and notices. Although The Windsor Apartments and Hotel Rooms, Brisbane may from time to time monitor or review discussions, chats, postings, transmissions, bulletin boards, and the like on this Website, The Windsor Apartments and Hotel Rooms, Brisbane is under no obligation to do so and assumes no responsibility or liability arising from the content of any such locations nor for any error, defamation, libel, slander, omission, falsehood, obscenity, pornography, profanity, danger, or inaccuracy contained in any information within such locations on the Website. You are prohibited from posting or transmitting any unlawful, threatening, libelous, defamatory, obscene, scandalous, inflammatory, pornographic, or profane material or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law. The Windsor Apartments and Hotel Rooms, Brisbane will fully cooperate with any law enforcement authorities or court order requesting or directing The Windsor Apartments and Hotel Rooms, Brisbane to disclose the identity of anyone posting any such information or materials.

Limitation of Liability 

Notwithstanding anything contained in these Terms and Conditions to the contrary, The Windsor Apartments and Hotel Rooms, Brisbane shall not be responsible for indirect damage, damage arising from consequential damage or special circumstances, including but not limited to loss of revenue, loss of profit, loss of use, loss of opportunity, arisen out of the performance or non performance of obligations under these Terms and Conditions. Onsite car parking is at own risk. The hotel is not liable for contents of stored luggage.

Insurance 

The Windsor Apartments and Hotel Rooms, Brisbane strongly recommends you purchase Comprehensive Travel Insurance. We suggest that the policy include, but not limited to, the following coverage – loss of payment through cancellation, loss or damage to personal baggage, loss of money and medical expenses.

Timeliness of Complaints / Refunds / Cash transactions

Complaints or errors must be raised immediately to provide the hotel with the ability, if acknowledged and agreed, to rectify accordingly. There are no refunds for issues which could be rectified. The hotel will endeavour to provide a faultless service.  

Governing Law and Jurisdiction

The products and/or services described in and available through the site may not be available in your country. We make no representation that the services or products offered in the site are appropriate or available for use in any particular location. The site is operated from Australia and it is governed by the laws of Australia, and the courts of Brisbane only.
